1. Acceptance of Terms

By accessing or using Lush ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after any changes constitutes acceptance of the new Terms.

2. Eligibility

To use Lush, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Platform under applicable laws
• Not have been previously banned from Lush
• Not be a registered sex offender

By creating an account, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. User Conduct

You agree not to:

• Post content that is false, misleading, defamatory, or offensive
• Harass, threaten, or intimidate other users
• Use the Platform for any illegal or unauthorized purpose
• Solicit money or financial information from other users
• Impersonate any person or entity
• Upload content containing viruses or malicious code
• Collect or harvest user information without consent
• Use automated systems or bots on the Platform
• Circumvent any security features or access controls
• Post sexually explicit content or engage in inappropriate behavior
• Spam or send unsolicited commercial messages
• Promote violence, discrimination, or illegal activities

5. Profile Content

You are solely responsible for the content you post on your profile. By posting content, you grant Lush a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Platform.

All profile photos must:

• Be of you (no group photos as primary)
• Be recent and accurately represent your appearance
• Not contain nudity or sexually explicit content
• Not infringe on any third-party rights
• Not contain violence, hate symbols, or offensive material

6. AI Verification

Lush uses AI-powered photo verification to maintain platform integrity. By using the Platform, you consent to:

• Having your photos analyzed by our AI systems
• Providing verification selfies for identity confirmation
• Automatic content moderation of uploaded media

We reserve the right to remove any content that violates our guidelines or fails verification.

7. Premium Subscriptions

Lush offers premium subscription tiers with additional features:

• Gold: $14.99/month with advanced features
• Platinum: $29.99/month with all premium features

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions through your app store account settings.

8. Refunds

Subscription fees are generally non-refundable. However, we may consider refund requests within 14 days of purchase if you have not extensively used premium features. Refund requests should be directed to our support team.

In-app purchases, including Roses, Boosts, and Super Likes, are non-refundable once used.

9. Safety and Reporting

Lush is committed to user safety. We encourage you to:

• Report any suspicious or inappropriate behavior
• Block users who make you uncomfortable
• Meet in public places for first dates
• Never share financial or sensitive personal information

We reserve the right to investigate reports and take appropriate action, including account suspension or termination.

10. Intellectual Property

The Platform and its content, features, and functionality are owned by Lush and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Platform without express permission.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Lush and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately.

You may delete your account at any time through the app settings. Some information may be retained for legal or legitimate business purposes.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.
